This privacy policy sets out how YouGetMe (“we”, “us” “our” and “YouGetMe”) collect, store and use your personal information, and the personal information of third parties you provide to us. By using our App, you consent to the collection, storage and use of your personal information in accordance with this privacy policy, which may be updated from time to time.

Collection Of Personal Information

To establish an account and use our App, we collect the following personal information:

  • Username;
  • Profile photos (where you elect to upload them);
  • Social media profiles and social profile user information, where you elect to create or link an account on the App using Facebook or Google;
  • Videos you upload, to the extent they include personal information;
  • Your voiceover audio recordings where you elect to upload them;
  • Text messages you send or receive on the App;
  • Comments, feedback, emails, reviews and other information (“Feedback”) you upload or provide to us, the Website or App, to the extent such Feedback includes personal information;
  • IP address;
  • Website statistics, usage logs and analytics data regarding your use of the Website and App;
  • Other types of raw data relating to how you interact with the Website, for example, your device, browser and session duration information; and
  • All other personal information you provide on our Website or App or otherwise, including as part of your communications with us or other users.

Personal Information of Third Parties

To the extent you provide us with, or upload data that includes the personal information of another person, including using video content that includes images of them, you represent and warrant that you have their authorization to provide us with that information in accordance with this privacy policy and our Terms and Conditions of Use.

The Use and Disclosure of Your Personal Information

The collection of your personal information, and the personal information of third parties you provide to us, may be used to:

  • Facilitate the operation of the Website and App, including hosting our App and your personal information on the servers of third-party providers and contractors;

  • Send you emails to facilitate resetting your password for the App;
  • Send you push notifications in the App where you elect to permit notifications on your mobile device;

  • Support and improve the Website and App we offer;

  • Communicate with you about your account, updates to our terms and conditions of use, policies or services we offer;

Use of Contractors and Third-Party Service Providers

We also operate the Websites and App in conjunction with, or engage the services of independent contractors, service providers (for example data hosting providers and email providers) advertisers, partners and employees (“Providers”). Our Providers may have access to, or store, your personal information in providing services to us, or providing you with access to the Website and App. We may use a variety of Providers and they may have servers, operations or be physically present in locations both inside and outside of Canada or your home jurisdiction, which may make your personal information the subject of foreign laws and foreign legal proceedings.

As of the date of the last revision to this Privacy Policy, any data uploaded or stored in connection with your account, including any user content you upload (images, videos and text) is hosted via Amazon Web Services, Inc. or its affiliates.

We cannot make any guarantees as to the location(s) of data stored on our behalf by the above Providers.

Disclosure Pursuant To Court Order, Subpoena Or Other Legal Process

We reserve the right to provide your User Content and personal information uploaded or collected by our Website or App to third parties if required by law (such as in response to a subpoena, court order or other legal process in any jurisdiction), and to cooperate with law enforcement authorities in the investigation of any criminal or civil matter.

If we are required by law to make any disclosure of your User Content or personal information, we may, but are not obligated to, provide you with written notice (to the extent permitted by law) prior to such disclosure so that you may take appropriate action.

Disclosure of Personal Information in Event of Acquisition

We may also disclose your personal information to our successors (if our business or the App is acquired by another legal entity) or any assignee of our assets relating to the Website and App.

European General Data Protection Regulation

Our privacy practices intend to meet the requirements of the General Data Protection Regulation of the European Union (“GDPR”). As a company that may process the personal information of persons who reside in or are citizens of the European Union (a “European person”), we have implemented appropriate technical and organizational measures to meet the GDPR’s requirements and protect European personal information. To the extent you provide us with, or, have our App process any personal information of a European person, you represent and warrant to us that you have obtained informed consent from such person to transfer their information, internationally, to us. We keep your personal information for as long as it is required for the purpose for which it was collected. There is no single retention period applicable to the various types of personal information collected. When any personal information is no longer required for the purposes for which it was collected, we may destroy it in a manner that takes into account its sensitivity.

Limitation of Liability in Respect of Personal Information

WHILE WE TAKE MEASURES TO PROTECT PERSONAL INFORMATION, YOU AGREE THAT, TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE, OUR AFFILIATES, OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES OR CONTRACTORS BE LIABLE, HOWSOEVER CAUSED, FOR THE LOSS OR THEFT OF YOUR PERSONAL INFORMATION OR ANY DAMAGES CAUSED AS A RESULT THEREOF, SO LONG AS WE WERE NOT GROSSLY NEGLIGENT IN THE PROTECTION OF SAID INFORMATION.
